Know that you’re not alone. That’s the first thing to remember. Separation and divorce seems to be everywhere, but there are ways to reduce your stress level. You start with sound legal advice from a lawyer like Katherine Kubica. With twenty-three years of experience in family law, she has seen just about everything.

For married couples, assets and property are governed by the Matrimonial Property Act (a provincial statute of Alberta, and are divided with a presumption of equality, subject to some factors which may affect an equal division. Katherine can advise you on all of this.

 

The assets of common law couples are dealt with differently; ie. your assets with your name on them and debts under your name are yours and the same with his/hers,  but sometimes that leads to unfairness where one common law spouse is unjustly enriched -- and the other suffers a corresponding deprivation which is dealt with in the common law area of equity.  Just know the goal is an equitable resolution for both of you.

Not all separatons go smoothly, however, and if it's a rocky road you're on because your wife refuses to let you see the kids, or because your common law wants half of the business you built up before you even met her, Katherine will tell you the law and your options to your face.
